2. Scope of Service

ClipDraft is a web-based AI tool for creating TikTok videos. It includes the following features: (a) on-demand generation of short video files from prompt input, (b) processing user-uploaded videos, (c) reusing the most recently created video, (d) automations — scheduled, daily video creation based on predefined categories (e.g., News, Motivation, Custom), and (e) free Creator Tools — AI-powered text tools accessible without login (Hashtag Generator, Caption Writer, Script Writer, Bio Generator, Video Ideas Generator, Posting Schedule). Optionally, resulting videos can be exported as TikTok drafts (Inbox Draft) via official TikTok APIs, subject to availability and TikTok approval.

No automatic posting: In draft mode, ClipDraft does not publish content automatically. Final posting is performed by you inside the TikTok app.

3. Requirements & Acceptable Use

• You may only use ClipDraft with accounts you are authorized to use.
• You are solely responsible for your content (prompt, video, caption, hashtags) and legal/TikTok compliance.
• For own video uploads, you confirm that you hold all required usage rights.
• Abuse (spam, limit circumvention, unauthorized automation) is prohibited.

Prohibited Content and Uses

The creation or distribution of the following content via ClipDraft is strictly prohibited:

• Deepfakes or deceptively realistic depictions of real persons without their explicit consent.
• Sexual, pornographic, or age-restricted content.
• Violent content, hate speech, discrimination, or content that violates applicable law.
• Political campaign advertising or misleading political content.
• Content presented as medical, legal, or financial advice.
• Using ClipDraft-generated outputs to train other AI models or develop competing products.
• Any automated use beyond the intended automation feature (e.g., scraping, bot access).

ClipDraft reserves the right to suspend accounts for violations of these rules.

4. TikTok Connection (OAuth)

• Account linking is done through official TikTok OAuth login.
• You grant scopes actively; ClipDraft uses them only for actions you explicitly trigger.
• You can revoke authorization in TikTok at any time; then ClipDraft can no longer act for that account.

5. Content & Rights

• You retain all rights to your content (prompts, uploads, generated files).
• You grant ClipDraft a limited, non-exclusive license to process content solely to provide the service (e.g., process, transfer/upload, status checks).
• You represent that you hold all required rights (copyright, trademark, personality rights, etc.).

AI Outputs: Special Rules

• Non-uniqueness: AI-generated videos are not guaranteed to be unique. Other users may receive similar or identical results.
• Service improvement: ClipDraft may use inputs and generated content in anonymized form for quality assurance and service improvement.
• No AI training: Using ClipDraft outputs to train other AI models or develop competing services is prohibited.
• Labeling: You are responsible for labeling AI-generated content in accordance with TikTok requirements and applicable law, where required.

6. Availability, Changes

ClipDraft is provided “as available”. Features may change or be removed (e.g., due to TikTok policy changes, technical reasons, or security requirements). No specific availability level is guaranteed.

7. Third-Party Services

ClipDraft uses third-party services (especially TikTok APIs and a video-generation provider). Those services are subject to their own terms. ClipDraft is not liable for third-party outages or decisions.

8. Liability

Liability is governed by applicable law. For slight negligence, liability applies only for breach of essential obligations and is limited to typical, foreseeable damages. No liability for TikTok decisions/actions (e.g., moderation, account restrictions, API changes) or third-party service outages.

AI outputs: Generated videos are machine-created and may contain inaccuracies, errors, or unexpected content. They do not constitute legal, medical, financial, or other professional advice. The provider accepts no liability for damages arising from the use or publication of AI-generated content.

9. Termination

• You can stop using the service anytime and revoke TikTok authorization in TikTok.
• The provider may block access in case of violations or security/compliance reasons.

10. Governing Law

German law applies, unless mandatory consumer protection rules provide otherwise.
